Network Security and Privacy Liability
⇒ Network Security Liability
This cover ensures the covering by the Insurer of the following costs:
- The transmission of malware to a third party's computer system;
- Clients' computer systems being used to carry out a denial of service attack;
- Clients' failure to prevent unauthorized access to information stored or applications, hosted on clients' computer systems or a third party's computer systems;
- Identity theft, experienced by clients' employees, senior executive officers or any third party.
⇒ Privacy Liability
This cover ensures the covering by the Insurer of the following costs:
- An actual or suspected disclosure of or unauthorized access to any Personally Identifiable Information, including payment card information or Protected Health Information;
- Clients' failure to adequately warn affected individuals of a privacy breach, including the failure to provide a data breach notification in a timely manner;
- A breach of any rights of confidentiality as a direct result of your failure to maintain the confidentiality of any data pertaining to an employee or a senior executive officer;
- A breach of any rights of confidentiality, including a breach of any provisions of a nondisclosure agreement or breach of a contractual warranty relating to the confidentiality of commercial information, Personally Identifiable Information, or Protected Health Information;
- A breach of any part of clients' privacy policy;
- Actual or suspected disclosure of or unauthorized access to your data or data for which clients are responsible.

The Insurer will pay on behalf of any senior executive officer all sums they become legally obliged to pay as a result of any claim made against them arising directly out of a cyber event first discovered by the client during the period of the policy.
The Insurer will also pay costs and expenses on behalf of clients' senior executive officers.
⇒ Regulatory Fines
The Insurer agrees to pay any fines and penalties resulting from a regulatory investigation arising as a direct result of a cyber event first discovered by clients during the period of the policy.
The Insurer agrees also to pay costs and expenses on the client's behalf.
⇒ PCI fines, Penalties and Assessments
The Insurer agrees to pay any fines, penalties and card brand assessments including fraud recoveries, operational reimbursements, non-cooperation costs and case management fees which clients become legally obliged to pay to clients' acquiring bank or payment processor as a direct result of a payment card breach first discovered by the client during the period of the policy.
The Insurer also covers costs and expenses.
